  1. Definitions

Introduction:

The customer agrees to use company’s website (the “Website”) only for purposes that are permitted by this Terms & Condition and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.

The customer agrees that he will not access or attempt to access the Website other than through the interface that is provided by the company, unless he has specifically been permitted to do so in a separate written agreement signed by an authorized representative of the company.

The customer specifically agrees not to access or attempt to access the Website, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers. The customer agrees that he will not engage in any activity that disrupts or otherwise interferes with the Website (or the servers and networks which are connected to the Website). The customer agrees that he will not duplicate, reproduce, copy, sell, trade or resell the Website for any purpose.

The customer agree that he is solely responsible for any breach of his obligations under this Terms & Condition and for the consequences (including any loss or damage which the company may suffer) of any such breach.

United Arab of Emirates is our country of domicile.

Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website.If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

The cardholder must retain a copy of transaction records and Merchant policies and rules.

We accept payments online using Visa and MasterCard credit/debit card in AED

  1. Customer’s account and amendment to the terms of use:

The customer may be required to register with Company’s website in order to access certain services or areas of the Site. With respect to any such registration, The Company may refuse to grant to the customer’s user name he request. The customer user name and password are for his personal use only. If he uses the Site, he is responsible for maintaining the confidentiality of his account and password and for restricting access to his computer, and he agrees to accept responsibility for all activities that occur under his account or password. In addition to all other rights available to the company including those set forth in these Terms & Conditions, the company  reserves the right, in its sole discretion, to terminate customer’s account, refuse service, or cancel orders.

The company may from time to time modify or change the Terms and Condition. The revised Terms of Use will govern customer’s future use of company’s Site and Service, so the company strongly suggests that customer should visit and review the Terms of Use periodically. Each version is specifically dated. If the customer does not agree to the revised version, he must immediately stop using the company’s Site and Service. Our Terms of Use were last updated on May 20, 2017, Terms and Conditions Agreement applies from this date onwards.

 

  1. PRICES

·         Website Prices.

Prices shown  are per day  with free delivery inside UAE  for any  order above 5,000 AED.

All fees and prices are in UAE Dirhams (AED) .

·         Changing of Prices.

The prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer or sales. Prices of items that are not in stock or that are available for a pre-order are valid during its promotional period after the order was placed. Should the price of those items change with respect to the pre-order price, Customer will be informed and will have the possibility to cancel the order. The company reserve the right to update prices displayed on the website from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

·         Typographical

The company strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on the Website. Due to human error and other determinates the company cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information listed is entirely accurate, complete or current, nor can the company assume responsibility for these errors. In the event a product listed on the Website is labeled with an incorrect price due to some typographical, informational, technical or other error, the company shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Additionally, all hyperlinks to other Websites are provided as resources to customers looking for additional information and/or professional opinion. The company does not assume responsibility for the claims and/or representations made on these or any other Websites.

  1. Orders & Delivery

Placing an Order

Placing an order can be done from the website after contacting the company and confirm the availabilty. Should the customer place an order from the website; he has to be sure that personal data is correct and updated. The company suggests the Customer to proof-read his/her form several times before validating an order. The company is neither responsible for sending e-mails to the wrong e-mail address nor for sending parcels to the wrong delivery address if the form is incorrectly filled-out.

Delivery & Processing Time

The customer can expect his order to be processed within approximately 72 hours for UAE delivery address While it may take 1-2 weeks for outside -country delivery .provided the items are in stock and there are no problems with payment verification. The company does not guarantee same day-shipping. Orders are not processed on weekends and holidays.

Camerayastore.com will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.

 

Collecting/Returning

  • Orders Inside UAE :
    Order Above 5,000 AED ,The company will deliver and collect back the equipment free of charge .
    Order Below 5,000 AED , The customer will shoulder the delivery and returning the equipment
    From /To the address mentioned in the quotation and/or Invoice. It is under the customer responsibility
    to collect and return the rented equipment in perfect condition. The company may offer optional delivery
    and collection fees based on the total chargeable weight ,shipment volume and shipping address.

 

  • Orders Outside UAE :
    For any international order , The customer will shoulder the delivery and returning the equipment
    From /To the address mentioned in the quotation and/or Invoice. It is under the customer responsibility
    to collect and return the rented equipment in perfect condition. The company may offer optional delivery
    and collection fees based on the total chargeable weight ,shipment volume and shipping address.

 

 

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The company reserves the right at any time after receipt of your order to accept or decline your order for any reason. The company reserves the right at any time after receipt of your order, without prior notice to the customer, to supply less than the quantity he ordered of any item. The company may require additional verifications or information before accepting any order.

Order Acknowledgement

The company will keep the customer informed of his order status via e-mail. All tracking information will be emailed to email address provided by the customer. Once your order has processed or changed status.

 

Change Orders

The customer may request a change to his order provided the order has not already been charged to his account. Please call us during company’s hours of operation to request a change to your order. Please have your sales order (SO) or customer number ready for better assistance. We strongly discourage sending change order requests via email because it is unlikely we will receive the message in time to make an adjustment due to the sheer volume of emails we receive each day.

 

  1. Terms of Payment

 

  • Payment of invoices shall be made without any deduction or set-off so as to be received by the Company in advance of the service.
  • The company accepts payments as below :
    • Bank Wire Transfer, the company banks details would be reflected in the invoice. However any bank transfer charges should be borne by the customer.
    • Online payment through company’s website, the website will implement PAYFORT which is a trusted online payment gateway enabling businesses, governments, SMEs, startups and institutions with innovative payment options for both the banked and non-banked online shoppers. Any orders placed with Cards issued from USA based banks shall begin fulfillment only post confirmation from the Card Issuing Banks & PayFort. As such, these orders will not be deemed eligible for Next Day Delivery.

 

In order to protect the website visitors to the best of our knowledge, we implement several security policies and certificates. These layers of protection could be by-passed if the user’s computer is/was infected with a virus or malicious software. The company or its associated partners and employees cannot be held responsible in such a scenario or circumstance. The company reserves the right to refuse a delivery or honor an order from a Customer who has not paid part or the totality of a previous order or with whom a litigious dispute is in progress. The company also reserves the right to take any necessary steps including legal action in case of outstanding or non-payment of fees by the customer.

  • In the event of a default in payment the Company reserves the right either to withhold any equipment or services which are the subject of any contract with the Customer and/or cancel any subsequent contract with the Customer without prior notice.
  • The Company shall be entitled to terminate any contract without notice in the event of the bankruptcy insolvency or liquidation of the Customer (as the case may be) any time during the contract.
  • The Company reserves the right to make a charge in respect of any costs or expenses incurred by the Company on account of the Customer for any contracts which are subsequently cancelled.
  • The Customer agrees that in the event of a default in payment for the hire the Company may place full details of the Customer default with an independent bureau for the purpose of compiling and distributing such information to other interested parties to assist in making decisions from which the information may be used for tracing, the prevention of fraud and the recovery of debt amongst other matters.

 

  1. Period of Hire
  • The hire charge for equipment commences and ends on the dates agreed by the Company.
  • The hire period will be deemed to continue until such time as any damaged equipment is repaired or any equipment that is lost, stolen or damaged beyond repair is replaced provided that the amount of any additional hire charge payable as a direct result of the theft, accidental loss or damage to the equipment shall not exceed 13 weeks rental.
  • Where equipment is delivered or collected by the Company such delivery or collection is at the Customers risk and expense and the Customer shall be liable for physical loss and damage and delay to the equipment as soon as the equipment is delivered to the address requested by the Customer in the case of delivery and until the equipment has been safely placed into a Company vehicle in the case of collection.

 

  1. The Companies and Customers Liabilities
  • While the Company shall make every effort to assist the Customer with technical know how and experience and shall provide general advice and service the Company shall not guarantee that the Customer will achieve his intended result by the use of hired equipment and services.
  • The Company shall not be liable in any way for any loss, damage, loss of profits or of contracts or of any other consequential loss of any kind suffered by the Customer or any third party or for any delay, late delivery, defect or deficiency of or relating to any equipment or ancillaries there to or for any delay in any equipment or ancillaries being available or for any failure error or mistake by technicians or other staff or for any failure error or mistake by any technicians or other staff of any nature provided by the Company.
  • The Company shall not be liable for any delay or other breach resulting from wars strikes lock-out restrictions non-availability of goods materials or labour or owing to any other cause whatsoever beyond its control.
  • Time is not of the essence in any contract with the Customer and the Company shall not be liable for any delays in the supply of equipment materials and services by it or for any losses whatsoever due to any such delays howsoever caused.
  • All equipment and materials entrusted to the Company and all equipment and materials and services supplied by the Company are entirely at the Customers risk. The Company shall not in any circumstances be liable for loss or damage of any kind, howsoever caused, even where such loss or damage shall have been caused or contributed to by the negligence of the Company.
  • The Company shall not be liable for any costs incurred in getting replacement equipment to the Customer in the event of the breakdown of that equipment even where such a breakdown shall have been caused or contributed to by the negligence of the Company.
  • If it is proved to the satisfaction of the Company its directors or its managers that any equipment hired by the Customer has broken down through the fault of the Company its directors or its employees the Company will not make charges for that equipment from the time it breaks down until the time it is replaced or repaired provided that in the event of the equipment being replaced the Customer returns the faulty equipment within 24 hours of the faulty equipment being replaced otherwise a charge will be made commencing 24 hours from the time the replacement equipment is provided and ending once the faulty equipment has been returned to the Company. The responsibility for the delivery of any replacement equipment and the return of any faulty equipment rests solely with the Customer.
  • The Customer shall be required to insure its materials and its work and operations against any loss damage or liability caused by or arising out of or in connection with equipment materials or services supplied by the Company or any contract with the Company. The Customer shall inform insurers of the Company’s Terms and Conditions and shall ensure that its policy is endorsed to the effect that there shall be no recourse against the Company.
  • The Customer shall at all times keep the Company its directors employees servants agents and licensees fully indemnified against all actions, proceedings, expenses, costs, charges, claims and demands whatsoever which may be brought against the Company its employees servants agents or licensees by any third party in respect of any alleged injury, loss, damage or expense arising out of or in connection with equipment or services provided by the Company or for breach of copyright or any other proprietary or other rights of third parties generally resulting from compliance with the Customers instructions even where such injury, loss, damage or expense is caused wholly or in part by the negligence or breach of contract of the Company its directors servants or agents.
  • The Customer shall further compensate the Company for any loss which the Company may suffer as a result of variation of any order for the supply of equipment materials or services or failure to return any hired equipment to the Company’s premises at the termination of the agreed hire period in good condition fair wear and tear excepted or for any breach by the Customer of these Conditions.
  • If the Customer takes equipment hired from the Company outside the United Arab Emirates and is delayed in returning the equipment due to hold-up by Customs officials or for any other reason full hire charges will be made until the equipment is returned to the Company’s premises or collected by an employee of the Company.

 

  1. The Customers Insurance
  • Without specific written agreement to the contrary prior to the commencement of the hire period the Customer shall affect its own insurance on the equipment. The Customer shall ensure that the Company’s interest is noted by the insurers and shall notify the Company accordingly and give such other details of the policy or policies as the Company may require. The Customers policy shall provide cover for all loss or damage whatsoever to the equipment including, but not limited to, the full replacement value of the equipment, the full cost of repairing any damage and the continuing hire charges detailed in clause 6 b) above. Particulars of replacement values, repair costs and daily rates for continuing hire will be supplied by the Company on request as appropriate.

 

  1. The company’s Insurance

 

The Company may at its discretion provide insurance to the Customer when the Company is providing crew with equipment for hire. Agreement by the Company to do so must be obtained in writing and any insurance so provided is subject to the Terms and Conditions of the Company’s insurance.

 

  1. Failure to Return Goods/Damaged Goods

 

The Customer shall pay to the Company the full replacement value of hired equipment not returned or the full cost of repairing any damage together with any additional hire charge calculated in accordance with Clause 6 of these Conditions due to loss or damage. Where in accordance with Clause 10 of these Conditions, the Company undertakes to effect insurance in respect of equipment supplied the Customers’ liability under this Clause will be reduced by the amount recoverable under such insurance.

 

  1. Late Returns

 

Equipment returned late will be charged at the single agreed daily rate for each calendar day or part thereof irrespective of any reduction or discount that may have been negotiated on the original booking.

  1. Cancellation/Curtailment

 

  • If notice of cancellation or curtailment is received by the Company at 24 hours or less notice, then the booking will be charged at full rate. Similarly, bookings cancelled more than 24 but less 48 hours before a booking begins will be charged at 70% of the full rate and bookings cancelled more than 48 but less 72 hours before a booking begins will charged at 30% of the full rate.

 

  • Refund Policy:
    Refund will be accepted under one of below reasons:
    1- The product is faulty or is not of acceptable quality.
    – The product will be inspected on return.
    – We only accept returns sent to us within 24 hours for UAE orders and 72 hours for international orders.
    – The items must be sent back to us in original condition.
    – If you received a faulty item the company will shoulder the cost of shipping back the item. We will also cover the cost of shipping of the replacement item.
    – Upon approval ,Please allow up to 14 days for your return to be processed. All refunds will be provided via the original method of payment.
    2- The product does not match the purchase description.
    – The product will be inspected on return.

  1. Use of Equipment

 

Without the previous consent of the Company hired equipment must not be used on any abnormal or hazardous assignment nor taken out of the United Arab Emirates or taken from the ground other than on a regular scheduled flight by an airline recognized by I.A.T.A. Customers must keep hired equipment in their custody and must ensure it is used in a skillful manner by persons having the appropriate qualifications and experience and who are familiar with the type of equipment. Customers must protect hired equipment from the elements and take all reasonable precautions for its safety. Under no circumstances may Customers alter, add to, modify adapt or misuse equipment hired to them by the Company or affix to, install thereon or insert therein any accessory equipment or device incompatible with its proper use.

 

  1. Condition of Goods
    a) All equipment and materials supplied by the Company shall be examined and checked and subjected to appropriate tests by the Customer before being taken into use and if found to be defective or deficient will be replaced or defects and deficiencies remedied by the Company without additional charge but in no circumstances shall the Company be liable for transportation charges or for any loss or damage of whatever kind howsoever caused arising out of or in connection with the use or the inability to use equipment and materials supplied or agreed to be supplied.
    b) The Company shall at its own expense at all times during the hire period make any repair or supply such replacement of equipment as may be necessitated by ordinary wear and tear provided that the Customer returns any equipment needing attention to the Company’s premises. Carriage insurance and handling charges including charges for the return journey of repaired or replacement equipment to be paid by the Customer. The Company will suspend the hire charge during the period in which the equipment is out of service or until it is replaced as the case may be but the Company shall in no circumstances be liable to the Customer for any loss or damage or expense incurred or sustained in connection with or resulting from the return or repair or replacement of such equipment.

 

  1. Company Vehicles

 

No person other than a person authorised by the Company may in any circumstances drive any vehicles supplied by the Company. Where such vehicles are used by or on behalf of the Customer in circumstances not covered by the Company’s insurances, the Customer undertakes to effect the appropriate insurance. No one may drive a Company vehicle without a valid United Arab Emirates driver’s license.

 

  1. Title
    a) All equipment on hire shall at all times remain the absolute property of the Company and no proprietary or other interest in the said equipment shall vest in or pass to the Customer who shall for all purposes be deemed the Bailee of the said equipment.
    b) Customers must not sell loan assign pledge encumber part with possession or suffer any lien to be created over hired equipment and the Company may terminate any hiring forthwith and without notice in the event of a Customer making any attempts to do so or doing any act or omitting to do any act which in the opinion of the Company jeopardises the Company’s rights to the equipment or becoming the subject of any bankruptcy or liquidation proceedings or becoming insolvent or allowing any judgment or well-founded claim to remain unsatisfied or failing to pay any hire charge or other sum due to the Company or failing to comply with these Conditions.
    c) The Customer agrees that a representative of the Company may enter upon any premises upon which hired equipment may be kept or reasonably believed to be kept for the purpose of its recovery at the termination of any hiring period, and where such equipment is on premises not occupied or under the control of the Customer, the Customer shall undertake to secure for the Company permission to enter for such purposes and the Customer shall compensate the Company for any costs incurred in repossessing the hired equipment.
  2. Customers Property

 

The Company shall have a general lien upon all materials now or at any time in its possession belonging to the Customer for any sum for the time being due to the Company.

  1. General

No acceptance of the return or repossession of the equipment nor the granting of any indulgence by the Company shall constitute a waiver by the Company of any of its rights under these Conditions.

 

Any advice, instruction, guidance representation or statement in connection with or in relation to the nature and use and application of any equipment materials or services supplied by the Company given or made by any director or any servant or agent of the Company or by any technician whose services are supplied to the Customer is given or therefore or for loss or damage of any kind resulting therefrom howsoever caused. No recommendation or nomination by the Company of any person whose services the Customer engages shall in any circumstances render the Company its director’s servants or agents liable for any loss or damage of any kind resulting therefrom or connected therewith however caused.

 

  1. Privacy

 

  1. The company takes reasonable measures (physical, organizational and technological) to safeguard against unauthorized access to customer’s personally identifiable information and to safely store their personally identifiable information. However, the Internet is not a secure medium and the privacy of the customer’s personal information can never be guaranteed. The company has no control over the practices of third parties (e.g. website links to this Site or third parties who misrepresent themselves as you or someone else). The customer agrees that the company may process his personal information that he provide it for the purposes of providing the services on The company website and for sending marketing communications to the customer, and that the Privacy Policy of this Site governs our collection, processing, use and any transfer of the customer  personally identifiable information.
  2. All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.
  3. The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore the Customers’ are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.

These terms and conditions shall be governed by and construed in accordance with the law of the United Arab Emirates.

  1. Governing Law

 

Any dispute arising out of or in connection with these terms and conditions, including any question regarding their existence, validity or termination, shall be subject to the exclusive jurisdiction of the Courts of the UAE.
